3 Mandatory California Labor Law Poster Updates in 2018

Several new labor and employment laws went into effect on January 1, 2018, that include three important updates to California Labor Law posters. All businesses in California are required to update their labor law posters if they were purchased before January 1, 2018. Here are the new changes:

  1. Transgender Rights in the Workplace Poster

This new poster addresses dress code protections and equal access to the use of restrooms and locker rooms for all transgender persons. This law went into effect on January 1, 2018.

  1. California Fair Employment Poster

This is an update to the current California Fair Employment poster and went into effect on January 1, 2018. Businesses with 50 or more employees must provide training for the prevention of sexual harassment, abusive conduct, and harassment based on gender identity, gender expression, and sexual orientation.

The California New Parent Leave Act for Small Employers requires employers with 20 or employees to provide up to 12 weeks of job-protected unpaid leave to qualified new parents.

  1. California OSHA Poster

This is an update to the current California OSHA poster reflecting the increase in penalties for violating the state’s occupational safety and health laws. Maximum fines have increased by nearly double for the first time in 20 years and are now set to the Federal standard. Best practice compliance date is January 31, 2018.

  • Section 6427 of the Labor Code was amended to increase non-serious fines.
  • Section 6429 of the Labor Code has increased fines for repeat violations and raised the minimum fine for repeat violations.
  • Section 6431 raised fines for posting or recordkeeping violations.
